Local 63 Appeals SCAA-0036-2011 at Formal Arbitration
On Thursday, December 15, 2011, in order to protect the integrity of Section 11.51 of the PCL&CA for the Longshore Division, Local 63, in conjunction with Local 13, appealed Area Arbitration Award SCAA-0036-2011 at a formal Area Arbitration hearing. Local 63 submitted overwhelming evidence that the ILWU Longshore Division locals retain the right to respect the picket lines of non-PCL&CA units of the ILWU as per longstanding Coast Arbitration precedent.

On October 26, 2011, at the request of the ILWU Coast Committee, President Peter Peyton testified before the House Committee on Transportation and Infrastructure, Water and Environment Subcommittee on The Economic Imporance of Seaports.

Miller Rules that New Off Dock Facility Does Not Involve New Technologies under the Tech Framework

In this case, the Union argued that SSA's move to Pier F, consolidating 3 gate operations into one operation at Pier F (which is off terminal), necessarily involves new technologies thereby requiring the employers to follow the Tech Framework which provides several levels of disclosure to the Union prior to implementation.
In SCAA-0034-2011, Area Arbitrator Miller held that he was not convinced that any new technologies were involved and therefore the Union is limited to filing Section 1 claims pursuant to Section 17 of the PCCCD.
The Union will review this case and keep the membership updated.
Local 63 Takes on and Reaffirms PCCCD Jurisdiction - Equipment Numbers
Local 63 Takes On and Reaffirms Marine Clerk Jurisdiction over Handling Equipment Numbers at the In/Out Gates
The Officers have been dealing with the ongoing issue of outside truckers performing Marine Clerk functions at various terminals, port-wide, when gate cameras are not able to read equipment numbers, including chassis numbers, gen set numbers, and container numbers. In that situation, various employers have allowed truckers to intercede and relay that equipment number information to Marine Clerks. Doing so is a direct violation of Section 1 and prior LRC agreements whereby the employers agreed that truckers and security guards will not give tower clerks equipment numbers that are not visible to the clerk in the tower. In that situation, a yard clerk or trouble window clerk, as applicable, must be called to handle the situation.
The Officers have addressed this issue with PMA on many occasions at LRC. On Friday, October 7, 2011, Local 63 Secretary Mike Ponce and LRC Rep Mike Podue drove to APM Terminal to have an on-site LRC and arbitration, if necessary, to resolve this matter. On the way to the terminal, the PMA contacted the Officers and conceded that Marine Clerks will not take equipment number information from outside truckers.
In summary, if equipment numbers cannot be read at the in-gate or out-gate, it is a Marine Clerk’s job to ascertain the equipment number and relay that information to the Tower Clerk. Marine Clerks are not to take that information from the outside trucker or security guard. If you have any difficulties with this issue at the terminal, please contact your Chief Supervisor and/or Business Agent right away.
Kagel Rules on Miller Award Concerning Vessel Superintendents doing Clerks' Work at PAG-WBCT
Coast Arbitrator John Kagel, in C-02-2010, ruled on the Employers appeal of SCAA-1-2010 and SCAA-2-2010. His ruling was that Superintendents are allowed to use technology to observe and monitor the operation only to the extent that they were allowed to do so prior to technology. They can relay their observations to the Supercargo who will make the determination of what the problem is and what to do about it. They cannot give specific directions regarding what to do beyond telling the Supercargo what they observed and having the Supercargo investigate further and then implement the day’s operational plan when making decisions what to do about the specific situation. The issue of micro-management due to the ‘pervasive assignment’ of a large number of Superintendents observing and interfering in the ability of clerks to do their normal work was left undecided. He said that a decision on that would require specifics as to situations and dates which we can collect and bring as an issue in a future arbitration.
Overall, it appears that Coast Arbitrator Kagel was intent on preserving the chain of command and the right of clerks to make the operational decisions in the workplace based on the employers' overall plan.

Local 63 wins Flowing the Cargo Coast Arbitration at PAG STS-Evergreen
Four times a charm when it comes to this series of arbitrations!!! Local 63 fought hard through 4 arbitrations to confirm through Area Arbitrator Miller and Coast Arbitrator Kagel that "flowing the cargo" is indeed Marine Clerks' Jurisdiction!
